PRIVACY NOTICE

1. INTRODUCTION AND RESPONSIBLE FOR PERSONAL DATA

NEBULA NETWORK, S.A. DE C.V. (hereinafter, NEBULA), is convinced of the importance of protecting personal data, which is why this Privacy Notice has been prepared to comply with the Federal Law on Protection of Personal Data Held by Private Parties and other applicable legal regulations. NEBULA, a company duly incorporated in accordance with the laws of Mexico, is responsible for the processing of your personal data and develops as its main activity: The habitual and professional offering of virtual asset exchange by subjects other than Financial Entities.

2. DATA COLLECTED

When using our Services, you, as the holder of personal data, will provide NEBULA with usernames, passwords, and personal identification data that allow NEBULA to connect to the systems of those entities where the Holder of Personal Data is a client, in order to provide the service of virtual asset intermediation. For example, the Holder may provide personal identification data consisting of names, usernames, biometric information, passwords, and/or account numbers to grant access to their personal information. Such personal information may include, among others, your name, email address, date of birth, gender, account information, account balance, transactions, and passwords.

2.1 Collected personal information.

To use the main functionality of our Services, we will ask you to provide your name and email address to access your account information. The way we collect, use, process, and store your Personal Information for the provision of the Services is detailed below.

3. PURPOSE OF PROCESSING COLLECTED PERSONAL DATA.

The information collected and processed will be used exclusively to provide the Services offered by NEBULA. We will not keep your Personal Information longer than necessary. The personal data provided will be kept as long as the commercial relationship is maintained or as long as they are necessary to provide our Services, or as required by legal requirements.

4. CONSENT.

We may access your account information (including any Personal Information) once you provide us with your name and email address.

Once your user information is received, in order to prevent unauthorized access to your information, we will have strict security procedures and functions in place, including encryption of any Personal Information we transfer to third parties, including adopting appropriate measures to safeguard the security of the Personal Information we provide to them.

7. ARCO RIGHTS

You may, at any time, revoke the consents given, as well as request from NEBULA the exercise of the following rights:

*Right to request access to your personal data being processed by us, being able to obtain information about your personal data, as well as a copy of them.

*Right of rectification, you may request NEBULA to change any of your personal data such as the address if it is not complete or it has changed, that is, when it comes to inaccurate or incomplete information (such as a change in address or any other information provided to NEBULA.

*Right to erasure in certain cases, such as withdrawing your consent to data processing, when it is illegal, or when the data is no longer necessary.

*Right to request restriction of the processing of your data in certain circumstances, such as when challenging the accuracy of the data or when the processing is unlawful and the data subject opposes its deletion, in which case we will only keep them for the exercise or defense of claims.

*Right to data portability, that is, to receive an electronic copy of your personal data or to request that it be transmitted directly to another controller provided that the legally established requirements are met.

*Right to object to the processing of your data in certain circumstances, in which case we will stop processing the data, except for compelling legitimate reasons or the exercise or defense of possible claims.

If you wish to exercise the aforementioned rights, you must send a written request detailing:

*The name of the data subject and address or other means to communicate the response to your request;

*The documents proving the identity or, where appropriate, the legal representation of the data subject;

*A clear and precise description of the personal data and purpose regarding which the rights mentioned above are sought.

  • If you are not satisfied with the service provided to you, you have the right to file a formal complaint with the National Institute of Transparency, Access to Information, and Personal Data Protection.

8. WITHDRAWAL OF CONSENT

You may revoke your consent given to NEBULA for the processing of your personal data, provided that they are not necessary to fulfill the purposes of the services provided by NEBULA, within the limits established by law and in accordance with the obligations established therein.

However, it is important to note that we may not be able to address your request or conclude the use immediately in all cases, as it is possible that for some legal obligation we need to continue processing your personal data, prior to the corresponding blocking process.

To effect such revocation, you can send the request to our Personal Data Protection department located in our offices at: Av. The aforementioned request must contain the following information:

9. INTERNATIONAL TRANSFER OF DATA

We inform you that some of our suppliers and third parties mentioned in this Privacy Notice may be located outside the United Mexican States, so the processing of personal data will involve an international transfer outside the United Mexican States.

In cases where such transfer occurs, we will have contractual guarantees in which the recipient of the personal data ensures a level of protection adequate to that required in the United Mexican States.

This Privacy Notice as well as the Services we provide may contain links to third-party websites, applications, and plugins. By accessing their links or allowing their connection, you may facilitate the collection or sharing of your data.
